2 pp, 7 ¾ x 12, autograph document signed in Harrison County, Texas, undated but 1861, TRENTON A. PATILLO, who was the receiver in a case involving a Texas estate in which a lawsuit was dismissed because the attorney was attending the State Convention (the secession convention) “held for the State of Texas at the city of Austin...in February AD 1861. Plaintiff avers that in consequence of the existence of War between the said State of New York as one of the United States of America and the State of Texas as one of the Confederate States of America that said claim for money became Confiscate and by force of the Statute...became the property of the said Confederate States and the right of action therefore was vested in said plaintiff.
“Plaintiff therefore moves the court to set aside said order of dismissal and to reinstate said case...in the name of the Confederate States of America...
“Because the pleadings...admit a large portion of the debt sued for...Because the attorney in charge...was necessarily absent in attending to a great public duty and was not absent from neglect...”
The document doesn’t define the specifics of the claim, but states that it involves R & N Dart, residents of the City of New York who were suing Mrs. Martha Adams, Executrix of Chesley M. Adams of Harrison County, Texas.
Trenton A. and Frank J. Patillo established The Marshall Texas Republican on March 30, 1849. It was one of the states’ most articulate voices for states’ rights and secession. The weekly newspaper was sold to Robert W. Loughery, a Calhoun Democrat in 1851. During Loughery’s ownership, the newspaper became one of the most outspoken in the South. Loughery’s editorials were frequently reprinted around Texas. In the months before the war, the paper spoke forthrightly for withdrawal from the Union and it was among the staunchest supporters of the Confederacy during the war years. But once the war ended, the paper came out vigorously for conciliation and compliance with the requirements of surrender. (Research included)
Document is on blue paper with exceptional fine handwriting. Such Confederate documents are scarce as most have not survived the Civil War.
